USER ADDITIONAL TERMS AND CONDITIONS UPLOADS & MIRRORING
Syarat dan Ketentuan Tambahan ini (“Syarat dan ketentuan Tambahan”) adalah bagian yang tidak terpisahkan dari Syarat dan syarat dan ketentuan Pengguna (“Syarat dan Ketentuan”) Kami. Syarat dan Ketentuan Tambahan ini berlaku khusus untuk Pengguna yang mengunggah video ke Female Daily Network, dan/atau menautkan atau melakukan mirroring konten video dari platform pihak ketiga seperti TikTok, Instagram, Facebook, YouTube, atau platform sejenis (“Platform Pihak Ketiga”) pada Platform Female Daily Network.
Dengan menggunakan fitur Upload atau Video Mirroring pada Platform, Pengguna dianggap telah membaca, memahami, dan menyetujui Syarat dan Ketentuan Tambahan ini:
These Additional Terms and Conditions (“Additional Terms”) form an integral and inseparable part of our User Terms and Conditions (“Main Terms”). These Additional Terms specifically apply to Users who upload videos to Female Daily Network and/or link or mirror video content from third-party platforms such as TikTok, Instagram, Facebook, YouTube, or similar platforms (“Third-Party Platforms”) on the Female Daily Network Platform.
By using the Upload or Video Mirroring features on the Platform, Users are deemed to have read, understood, and agreed to these Additional Terms:
Konten Pengguna
Yang dimaksud dengan “Konten Pengguna” adalah semua konten yang Pengguna unggah atau tautkan ke Female Daily Network, termasuk video, audio, foto, teks, caption, voice-over, watermark, musik, desain, filter, serta materi lain yang melekat pada konten tersebut.
User Content
“User Content” refers to all content uploaded or linked by the User to Female Daily Network, including but not limited to videos, audio, photos, text, captions, voice-overs, watermarks, music, designs, filters, and any other materials embedded in or attached to such content.
Konten Bersifat Publik
Pengguna memahami bahwa Konten Pengguna yang diunggah melalui fitur publik dapat ditampilkan kepada pengguna lain maupun publik. Konten tersebut juga dapat muncul di beberapa fitur dalam aplikasi, misalnya feed, pencarian, rekomendasi, highlight, atau halaman tertentu lainnya dalam Platform.
Dikarenakan sifat unggahan adalah publik, maka Pengguna wajib memahami bahwa Konten Pengguna bisa mendapatkan komentar, reaksi, atau dibagikan ulang sesuai fitur yang tersedia, termasuk oleh pihak lain di luar kendali Female Daily Network.
Public Nature of Content
Users acknowledge and understand that User Content uploaded through public features may be displayed to other users and/or the general public. Such content may also appear in various sections of the Platform, including but not limited to feeds, search results, recommendations, highlights, or other designated pages within the Platform.
Due to the public nature of the upload, Users understand that User Content may receive comments, reactions, or be reshared in accordance with the available features, including by third parties beyond the control of Female Daily Network.
Hak dan Izin untuk Mengunggah
Saat Pengguna mengunggah dan/atau menautkan Konten Pengguna pada Platform, Pengguna menyatakan bahwa Pengguna adalah pemilik Konten tersebut atau memiliki izin yang sah untuk mengunggah dan membagikannya melalui Platform Female Daily Network. Pengguna juga menyatakan bahwa Konten tersebut, termasuk namun tidak terbatas pada wajah, suara, nama, maupun informasi pribadi yang terlihat atau terdengar dalam konten tersebut baik miliknya maupun orang lain yang berada di dalam Kontennya yang relevan telah mendapatkan izin dan Pengguna tidak melanggar hak pihak ketiga, termasuk hak cipta, merek, privasi, maupun hak atas gambar (rights of publicity).
Apabila terdapat pihak yang mengajukan keberatan atau klaim terhadap Konten Pengguna dalam Platform, Pengguna memahami bahwa Female Daily Network berhak mengambil tindakan yang diperlukan, termasuk membatasi akses atau menghapus Konten tersebut. Pengguna bertanggung jawab sepenuhnya atas setiap keberatan atau klaim yang timbul dari pihak ketiga sehubungan dengan Konten Pengguna, serta membebaskan Female Daily Network dari segala tuntutan, tanggung jawab, maupun kerugian yang muncul akibat hal tersebut.
Rights and Authorization to Upload
By uploading and/or linking User Content to the Platform, the User represents and warrants that they are the owner of such content or have obtained all necessary rights, licenses, consents, and permissions to upload and share it through the Female Daily Network Platform.
The User further represents that the content, including but not limited to any visible or audible faces, voices, names, or personal information—whether belonging to the User or to third parties appearing in the content—has been lawfully obtained and used with proper authorization, and does not infringe upon any third-party rights, including copyright, trademark, privacy rights, or rights of publicity.
If any party submits an objection or claim regarding User Content on the Platform, the User acknowledges that Female Daily Network reserves the right to take necessary actions, including restricting access to or removing such content. The User shall be fully responsible for any claims or objections arising from third parties in connection with the User Content and agrees to indemnify and hold harmless Female Daily Network from any claims, liabilities, or losses resulting therefrom.
Musik, Audio, dan Materi Pihak Ketiga
Pengguna hanya boleh mengunggah Konten Pengguna apabila Pengguna memiliki hak yang sah atas seluruh elemen dalam konten tersebut, termasuk musik, audio, cuplikan video, atau materi lain yang memiliki perlindungan hak cipta dan/atau hak terkait.
Pengguna memahami bahwa izin penggunaan musik atau audio di platform asal (misalnya TikTok atau Instagram) tidak selalu berarti izin tersebut otomatis berlaku untuk penggunaan di platform lain. Jika terdapat klaim pelanggaran hak cipta atau hak terkait, Female Daily Network berhak untuk menghapus, membatasi, atau menonaktifkan Konten dan/akun Pengguna kapan saja.
Music, Audio, and Third-Party Materials
Users may only upload User Content if they possess lawful rights to all elements contained therein, including music, audio, video clips, or other materials protected by copyright and/or related rights.
Users acknowledge that permission to use music or audio on the original platform (e.g., TikTok or Instagram) does not automatically extend to usage on other platforms. In the event of any copyright or related rights claim, Female Daily Network reserves the right to remove, restrict, or disable the User Content and/or User account at any time.
Izin Penggunaan Konten oleh Female Daily Network
Dengan mengunggah Konten Pengguna, Pengguna memberikan izin kepada Female Daily Network untuk menggunakan Konten Pengguna sejauh diperlukan untuk menjalankan dan mengembangkan layanan Female Daily Network. Ini termasuk menampilkan Konten Pengguna di Platform, menyimpan konten untuk kebutuhan sistem, serta melakukan penyesuaian teknis yang wajar seperti resize, crop, compress, atau membuat preview/thumbnail.
Pengguna juga memahami bahwa Female Daily Network dapat menampilkan Konten Pengguna pada kanal resmi Female Daily Network lainnya, misalnya media sosial, newsletter, landing page, atau materi promosi komunitas, selama masih dalam konteks yang wajar untuk memperkenalkan Platform, mengedukasi pengguna, atau menampilkan highlight komunitas.
License To Use Content by Female Daily Network
By uploading User Content, the User grants Female Daily Network a non-exclusive, worldwide, royalty-free license to use the User Content as necessary to operate and develop the services of Female Daily Network. This includes displaying the User Content on the Platform, storing the content for system purposes, and making reasonable technical modifications such as resizing, cropping, compressing, or creating previews/thumbnails.
The User also acknowledges that Female Daily Network may display User Content on its official channels, including social media accounts, newsletters, landing pages, or community promotional materials, provided such use remains reasonable and within the context of promoting the Platform, educating users, or showcasing community highlights.
Tidak Ada Kompensasi
Pengguna memahami bahwa penggunaan Konten Pengguna sebagaimana dijelaskan dalam syarat dan ketentuan Pengguna ini tidak menimbulkan kewajiban pembayaran, royalti, atau kompensasi dari Female Daily Network kepada Pengguna.
Apabila ada kerja sama komersial (misalnya campaign resmi, partnership, atau kontrak promosi), maka ketentuan berdasarkan perjanjian atau kesepakatan tertulis yang akan berlaku.
No Compensation
Users understand and agree that the use of User Content as described in these Terms does not create any obligation for payment, royalties, or compensation from Female Daily Network to the User.
In the event of a commercial collaboration (such as an official campaign, partnership, or promotional contract), the applicable terms shall be governed by a separate written agreement between the parties.
Syarat dan ketentuan Tambahan untuk Video Mirroring
Jika Pengguna melakukan mirroring atau menautkan konten dari Platform Pihak Ketiga, Pengguna bertanggung jawab untuk memastikan bahwa Pengguna memiliki hak yang sah untuk melakukan repost atau mirroring tersebut, dan bahwa tindakan tersebut tidak melanggar syarat dan ketentuan platform asal maupun hak pihak lain.
Female Daily Network tidak bertanggung jawab atas pelanggaran syarat dan ketentuan Platform Pihak Ketiga yang dilakukan oleh Pengguna.
Additional Terms for Video Mirroring
If a User mirrors or links content from a Third-Party Platform, the User is solely responsible for ensuring that they have lawful rights to repost or mirror such content and that such actions do not violate the terms and conditions of the original platform or the rights of any third party.
Female Daily Network shall not be responsible for any violation of Third-Party Platform terms and conditions committed by the User.
Moderasi dan Takedown
Female Daily Network berhak, namun tidak berkewajiban, untuk menolak, membatasi akses, menghapus, menonaktifkan, atau memblokir Konten Pengguna kapan saja apabila konten tersebut diduga melanggar syarat dan ketentuan Utama atau syarat dan ketentuan Pengguna ini, dilaporkan oleh pihak ketiga, menimbulkan risiko hukum, reputasi, atau operasional bagi Female Daily Network, atau dianggap tidak sesuai dengan standar komunitas Female Daily Network.
Moderation and Takedown
Female Daily Network reserves the right, but not the obligation, to refuse, restrict access to, remove, disable, or block User Content at any time if such content is suspected of violating the Main Terms or these Additional Terms, has been reported by a third party, poses legal, reputational, or operational risks to Female Daily Network, or is deemed inconsistent with Female Daily Network’s community standards.
Tanggung Jawab dan Ganti Rugi
Pengguna setuju untuk bertanggung jawab atas Konten Pengguna yang diunggah atau dimirror, termasuk apabila konten tersebut menimbulkan klaim pelanggaran hak cipta, merek, privasi, atau hak pihak ketiga lainnya.
Jika ada klaim, tuntutan, atau kerugian yang timbul terhadap Female Daily Network akibat Konten Pengguna, Pengguna setuju untuk membela, mengganti rugi, dan membebaskan Female Daily Network beserta afiliasi, direksi, komisaris, karyawan, dan perwakilannya dari klaim tersebut, termasuk biaya hukum yang wajar.
Responsibility and Indemnification
Users agree to be fully responsible for the User Content they upload or mirror, including any claims of copyright, trademark, privacy, or other third-party rights infringement.
If any claims, demands, or losses arise against Female Daily Network due to User Content, the User agrees to defend, indemnify, and hold harmless Female Daily Network, including its affiliates, directors, commissioners, employees, and representatives, from and against such claims, including reasonable legal fees.
Syarat dan ketentuan Lainnya
syarat dan ketentuan Pengguna ini dibaca sebagai satu kesatuan dengan Syarat dan Ketentuan Utama. Jika ada pertentangan antara syarat dan ketentuan Pengguna dan syarat dan ketentuan Utama, maka syarat dan ketentuan yang lebih spesifik terkait Pengguna Upload dan Video Mirroring yang berlaku.
Miscellaneous
These Additional Terms shall be read as one unified document together with the Main Terms. In the event of any inconsistency between these Additional Terms and the Main Terms, the more specific provisions relating to User Upload and Video Mirroring shall prevail.
